Welcome to BritishPay. These Terms and Conditions (“Terms”) set out the rules for using our website www.britishpay.co.uk and the BritishPay mobile application (together, the “Services”). By accessing or using our Services, you agree to these Terms. If you do not agree, you must not use our Services.

These Terms & Conditions (“Terms”) govern your use of the BritishPay mobile applications, website, and related services (“Services”). By creating an account or using BritishPay, you agree to these Terms.
1. About BritishPay
BritishPay is a digital payments platform providing wallet-based payments, QR payments, bank transfers, and merchant payment acceptance in the United Kingdom.
BritishPay is not a bank. Banking and safeguarding services are provided through regulated third-party partners.
2. Eligibility
To use BritishPay, you must:

Be at least 18 years old

Be legally permitted to enter into binding contracts

Provide accurate, complete, and up-to-date information

Complete identity and/or business verification where required
BritishPay may refuse access to anyone at its sole discretion.
3. Account Types
BritishPay supports the following account types:

Personal User (Individual)

Merchant / Business User (including sole traders and limited companies)
Different features, limits, and verification requirements apply depending on the account type.
4. Identity & Business Verification (KYC / KYB)
BritishPay is legally required to verify users.
Personal Users

Identity verification (KYC) is required to access withdrawals and certain features.
-
Limits may apply based on verification status and risk assessment.
Merchants / Businesses
-
Business verification (KYB) is mandatory.
-
Business owners, directors, or authorised persons may also be required to complete personal KYC.

Merchant accounts must use bank accounts held in the same legal business name.
Failure to complete verification may restrict or suspend your account.
5. Bank Accounts & Safeguarding
When you add or receive funds through BritishPay:

Customer funds are held in safeguarded bank accounts
-
Funds are held as bank deposits, not electronic money.

Customer funds are kept separate from BritishPay’s operational funds.

Funds are safeguarded in accordance with UK banking regulations.

Funds do not earn interest.
-
Funds are not covered by the Financial Services Compensation Scheme (FSCS).
6. Adding Money & Payments
BritishPay may offer:

Bank transfers

Card payments
-
Apple Pay / Google Pay
-
QR payments and Tap to Pay (for merchants)
Availability may vary by account type, verification status, device, and region. Fees may apply and are shown in-app.
7. Withdrawals & Limits
Personal Users

Withdrawals are available only after successful KYC completion.
-
Daily, monthly, and transaction limits may apply.
-
Limits may change based on risk, usage, or regulatory requirements.
Merchants
-
Withdrawals are permitted only to a verified business bank account in the same legal name.
-
Withdrawals to personal or third-party accounts are not supported.
-
Settlement times and limits may apply.
BritishPay reserves the right to delay, limit, or refuse transactions for compliance, fraud prevention, or risk management.
8. Fees
Fees, if applicable, are clearly displayed in the app before you complete a transaction.
BritishPay may update fees with prior notice where required.
9. Account Deletion & Closure
1. Right to Close an Account
Users may request closure of their BritishPay account at any time, subject to the conditions set out below.
2. Self-Deletion Before Verification
Account self-deletion is permitted only if:
Identity verification (KYC) or business verification (KYB) has not been completed, and
No bank account number has been issued.
In such cases, users may delete their account directly within the app.
3. Restrictions After KYC / KYB or Account Issuance
Once any of the following has occurred:
Identity verification (KYC) has been approved, or
Business verification (KYB) has been approved, or
A UK bank account number has been issued,
Self-deletion is no longer permitted.
This is because verification, compliance checks, and account setup incur non-refundable third-party costs.
4. Deletion by Support Request
After verification or account issuance, users who wish to close their account must:
Contact BritishPay Support, and
Submit a formal account deletion request.
BritishPay will review the request and provide instructions for account closure.
5. Account Deletion Fees
BritishPay reserves the right to charge a one-time account deletion fee to cover verification and account setup costs already incurred.
Fees may differ between personal users and merchant accounts
Merchant accounts may incur higher fees due to KYB and business checks
Fees are non-refundable
Account deletion will only be completed once any applicable fees have been paid.
6. Regulatory & Record-Keeping Obligations
Even after account closure:
BritishPay may retain certain information as required by law
This includes records for AML, fraud prevention, auditing, and regulatory compliance
Retention is carried out in accordance with UK law and our Privacy Policy.
7. BritishPay’s Right to Refuse or Delay Closure
BritishPay may refuse or delay account closure where:
There are outstanding balances, disputes, or investigations
Regulatory or legal obligations require continued access
Fraud, misuse, or suspicious activity is identified.
BritishPay is not obliged to refund any costs, fees, or charges incurred prior to account closure, including verification and account setup fees.
10. Suspension & Termination
BritishPay may suspend or terminate your account if:

You breach these Terms

False or misleading information is provided

Fraud, misuse, or unlawful activity is suspected

Required verification is not completed
Remaining balances will be handled in accordance with legal and regulatory obligations.
11. Data Protection & Privacy
Your personal data is processed in accordance with our Privacy Policy, available on our website.
We comply with the UK GDPR and applicable data protection laws.
12. Service Availability
BritishPay aims for high availability but does not guarantee uninterrupted service.
Maintenance, updates, or third-party outages may occur.
13. Liability
BritishPay is not liable for:

Losses caused by user error

Third-party service failures
-
Delays required by law or regulation
Nothing in these Terms limits liability where prohibited by law.
14. Changes to These Terms
We may update these Terms from time to time.
The latest version will always be available on our website with the “Last updated” date.
Continued use of BritishPay means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
